Well I’m recovering an injury and waiting on the Wonderful Capitalist Empire Health Care Industry™️ to do it’s thing, so there’s really not much else to be done, even if it needs doing. But at least I’m feeling better as long as I don’t push it too much, but losing weight during winter sounds fun! 😊

Oof, yeah that’s always slow to get fixed/paid for. I had a really bad hernia years ago at work and it took so long I had to get an attorney. They sent one letter that said “look, it’s only getting worse and if you don’t fix it now, it’s going to cost more, and it’s close to doing permanent damage, at that point it’ll cost you dearly.” Had surgery that week, and random big checks in the mail for the next few months. I hate the idea of being litigious but in America that’s about the only way to get gears turning anymore.

          Edit: quotes not exactly verbatim.

Yep, I’ve already consulted with a lawyer. I don’t really want them to take the case though because permanent damage settlement isn’t enough to live on and I don’t want them to take a lump sum. I should ask if they will write the letter and ask the cost, because they’re late on my payments constantly. They’ve already had to pay three late fees to me, and about to be another, and that’s fine, but it doesn’t cover late bill fees if I get behind, which I’ve managed to avoid so far. But compensation isn’t actual lost wages, either.

Edit: how are you doing now? Any residual issues? I remember hernia mesh issues.

I haven’t experienced any issues with the hernia mesh, thanks for asking.

Do you have an opportunity to work that wouldn’t further cause issues with your injury? Since mine was workman’s comp, I was given a bs job there where I basically just say around and collected money for a while until I was able to actually do physical things again but it sounds like yours is a bit more serious. Someone at my current job is going through a similar thing. She has to come in for 8 hrs but basically they’re saying there isnt a job she could do without hurting herself further. So she’s kinda in limbo, but she’s getting paid her normal wages plus the workman’s comp, so she’s relatively stable. It’s looking like she might just wind up getting paid very handsomely to just go away. At which point her job options would be rather limited.

Yeah, if they take the case, I’d ask for something like the surgery, compensation and a permanent desk job, with the reasoning that you just want to get back to work and feel normal again.

Oh I’m very glad you haven’t had issues. Some community members here did.

My employer waited a couple of weeks to turn it in and lied to me about it. I was to have an some tests and specialist consult stat. Now the insurance adjuster claims they are having difficulty getting a doctor to take me. So I don’t know. I am a bit concerned about asking for a desk job because where I am, retaliatory firings for filing WC is huge, although the reason on paper is always different, of course. We will see though.

That’s what the lawyer is for. If they try to fire you for bs, you’ll get enough money to do whatever you want with. Is it a union job by chance?

Thank you so very much for talking to me about this. I didn’t want to talk because I didn’t want to misstep. No, I’m in a very solidly red, Deep Southern state. Very little worker protections. A lawyer would take the case on contingency only. There are permanent damage issues, and one could develop into a life threatening issue years after settlement. So if I settle too soon, I’m messed up, but I can’t drag it out too long either, which is what the insurance company is doing with all this piecemeal care. The adjuster has been okay, I think they’re just kind of constrained by corporate but I could be wrong, since they obviously don’t work for me.
