What consequences are you thinking about? If you’re talking legal, I don’t expect db0 to press charges, and I don’t think he’s done anything legally significant to anyone else. Being a dick isn’t a crime.
Aside from that, odds are Tesseract is gonna disappear from most instances because mods generally like to have control of their moderation. I don’t know what other relevance he might have, but he’ll probably just fade from sight.
He’d already taken a hiatus, come back, been unhappy with the state of lemmy, tried to “fix it”, got called out. Maybe he’ll leave for good this time.
At the very least, I can’t see mods wanting to have a front-end that hides things in ways that they can’t turn off.
Otherwise, people on the blocklist would become effectively immune to moderators using the front-end, because they’d be completely hidden.
Yeah, I know that my instance’s admins have announced they’ll be shutting down their Tesseract frontend. As I said, I expect others will as well for the reasons you mention, but I haven’t kept track (and don’t see their posts pinned to my feed obviously) so I didn’t want to assume.

dbzer0.com is hosted out of Bavaria. that means his botnet crossed international borders which means he can be charged by every country along the way of the crime.
all it would take is some anonymous tips to the FBI and German authorities and he would be investigated and likely charged.
dude was an asshole for stuffing a hidden blacklist into his platform. once he made the change to create a botnet, he became a criminal.
I’m genuinely interested in knowing whether a case like this would be picked up at all. In the UK, it appears there is no minimal amount od damage incurred, so in such case I’d really think it’s possible. Db0 don’t even need to be the ones to sue or report the incident according to what I could find.

Those things don’t apply to most crimes. The whole “pressing charges” thing is a trope or meme, except for a few specific cases like minor assault, minor property damage, defamation, certain sexual offenses (varies greatly between municipalities), etc. The vast majority of crime is prosecuted by the state without needing the victim’s consent.
