This is what some not-very-good police do in some places. Arrest someone they don’t like and then dig up some ancient law still on the books that they broke on a technicality. Usually if such a thing goes to court the court strikes it down, if the justice system is remotely functional. But where’s Lemmy’s courts?
Iceland has been around long enough to have complex and outdated laws that are going to result in it happening even when it isn’t malicious, but also police institutions tend to attract at least some people who will abuse power until they are removed if the overall police structure discourages it.
So I am confident that it has happened unintentionally, but probably intentionally too at least occasionally.
