Last week’s Federal Court decision should reassure us that Australia won’t import the kind of anti-trans rhetoric we see overseas — but will continue to be a country where all women enjoy equality before the law.

Damages were doubled from $10,000 to $20,000 — including $8,000 for aggravated damages because of the way Grover conducted their case: misgendering Tickle and laughing in the witness stand when shown a demeaning caricature of Tickle…

The little details matter in cases like this, given the increasing normalization of disrespect against trans people. Not only is the court acknowledging that trans women are legally women; The court is also recognizing that misgendering a trans person is deliberate harm.

Completely unrelated note; “Giggle v Tickle” is a really funny court case name.

And in another thread about this, someone is arguing that real women will be harmed by this and that trans women shouldn’t get to be included.

They even wrapped it up in a barely disguised transphobic “this will harm the overall movement” bow.

I really enjoy seeing other countries succeed where my own has failed, and I mean that 100% genuinely. It reminds me that humanity isn’t all shitty.

I am very happy with this outcome as well. This should be the final ruling on this case unless it is accepted by the high court (highest court of Australia, like supreme court), which is unlikely. That said, we aren’t in the clear yet - all the major conservative parties and even the “left wing” state Labor government in NSW have pledged to amend the federal or local equivalent act to add back “biological” definitions of gender.
