That or because a court may determine that a “reasonable person” may conclude that it is officially connected or sanctioned by Bethesda. Though I am not a lawyer or IP law expert, so it is possible I may be wrong.
How are they violating copyright law? You have to provide the game files yourself, and it’s a freely available game.
